What is Allowed and What is Forbidden<\/strong><strong> will be granted under the following conditions:<\/strong><\/h2>\n<p><\/p>\n<ul>\n<li>The pergola's area shall not exceed 50 square meters or 1\/4 (whichever is greater) of the ground\/roof area upon which it is constructed.<\/li>\n<li class=\"translation-block\">The pergola will only be erected on the ground or on the roof of the structure (meaning not on balconies in buildings) unless otherwise specified in the permit, in accordance with spatial guidelines or the outline plan (this can be checked during public hours at the local planning and building committee).<\/li>\n<li>The pergola is not required to be attached to the building but must be within the permissible building lines (which can be obtained from the local committee).<\/li>\n<li>If you want to go beyond the building lines, you can deviate up to 40% from them (meaning if the building line is 5 meters from the front property boundary, you can deviate and get as close as 3.0 meters to the property boundary) but in such cases, a permit is required, and there is no exemption.<\/li>\n<li>According to the Pergolas Law of 2020, you must notify the licensing authority about the construction of the pergola within 45 days from the completion date of the work.<\/li>\n<li>You must include with the notification an approval from a structural engineer regarding the anchoring and stability of the pergola.<\/li>\n<\/ul>\n<p><\/p>\n<h3 class=\"wp-block-heading translation-block\">Application Form for Building Permit Exemption: <a href=\"https:\/\/forms.gov.il\/globaldata\/getsequence\/getHtmlForm.aspx?formType=ExemptionFromThePermit@RishuyZamin.gov.il&amp;InteractiveHouseElement=pergula\" target=\"_self\">Report of Work Exempt from Permit<\/a><\/h3>\n<p><\/p>\n<p><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1f5d013 elementor-widget elementor-widget-text-editor\" data-id=\"1f5d013\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<div class=\"container p-0\">\n<div class=\"articleMainContent\">\n<div class=\"articleContent\">\n<div class=\"articleTitle\">\n<h2>The Pergolas Law - Arnona (property tax)<\/h2>\n<h3>The Pergolas Law - Sanctioned<\/h3>\n<p id=\"ctl00_PlaceHolderMain_DeviceChannelPanel2_EditModePanel1_ctl00_articleTitle\" class=\"translation-block\">Approval for second and third readings: Adding a plastic roof to a pergola will not require property tax (Arnona) payment.\n\n<strong>This applies to municipalities where pergolas that are not covered by Arnona are not subject to property tax, and such a charge is only imposed for adding a surface covering to the pergola.<\/strong><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"container p-0\">\n<div class=\"articleMainContent\">\n<div id=\"articleContentMain\" class=\"articleContent\">\n<div id=\"ctl00_PlaceHolderMain_DeviceChannelPanel2_EditModePanel1_ctl00_articleText\" class=\"articleText\">The Finance Committee, led by Member of Knesset Moshe Gafni, approved today (Tuesday) the second and third readings of the bill proposed by Member of Knesset David Amsalem, 'Amendment to the Municipal Property Tax Law (Exemptions) (Pergola Exemption).'<\/div>\n<div id=\"ctl00_PlaceHolderMain_DeviceChannelPanel2_EditModePanel1_ctl00_articleText\" class=\"articleText\">\u00a0<\/div>\n<div class=\"articleText\">According to the order obtained, the law will not change the situation regarding municipalities that already impose property tax (Arnona) on pergolas regardless of whether they are covered or not. Instead, it will focus on municipalities where property tax is not levied on uncovered pergolas, and only adding a roof to a pergola will result in Arnona taxation.<\/div>\n<div class=\"articleText\">\u00a0<\/div>\n<div class=\"articleText translation-block\">In these municipalities, the law stipulates that placing a transparent plastic roof on a pergola that is not used for parking or storage will not require homeowners to pay property tax (Arnona) for the pergola area. For up to 20 square meters, no building permit is required.<\/p>\n<p>\u00a0For areas larger than 20 square meters, you must notify the licensing authority within 45 days from the completion date of the work. The notification should include an approval from a structural engineer regarding the anchoring and stability of the roofed structure or pergola. Here is the link:<\/p>\n<p class=\"translation-block\"><strong><a href=\"https:\/\/forms.gov.il\/globaldata\/getsequence\/getHtmlForm.aspx?formType=ExemptionFromThePermit@RishuyZamin.gov.il&amp;InteractiveHouseElement=gagon_back\" target=\"_self\">Application form for requesting a roofed structure above 20 square meters<\/a><\/strong>. (No building permit is required, only notification).<\/p>\n<p class=\"translation-block\">The roofed structure should be constructed using lightweight materials only, such as wood, glass, aluminum, steel, various polymers, or similar materials, with a weight not exceeding 50 kg per square meter of flat structure component (referring to beams). This does not include heavy ceramic tiles.<\/p>\n<p class=\"translation-block\">It's important to note that the roofed structure is subject to building rights (either as a primary or service area). Therefore, before construction, it is essential to ensure that there are unused building rights on the site, in accordance with the <a href=\"https:\/\/architecture.org.il\/\" target=\"_self\">Planning and Building Regulations<\/a>.<\/p>\n<p>(Calculations of areas and building percentages in plans and permits), 1992. The exemption does not exempt you from the need for building rights but rather from the need for a building permit only.<\/p>\n<p class=\"translation-block\"><strong>The Pergolas Law of 2020 - Folding Awning:<\/strong> The guidelines for exemption are similar to those for pergolas and roofed structures. It should be ensured that the folding awning does not protrude more than 50 cm from the closed position towards the building wall.<\/p>\n<p class=\"translation-block\"><strong>Net\/Shade Canopy:<\/strong> The exemption applies to shading achieved through an awning that provides protection from the sun and the effects of weather conditions, as long as the height of the awning does not exceed 3 meters, the span between the columns does not exceed 5 meters, and the weight of the awning does not exceed 3.5 kilograms per square meter.<\/p>\n<div>\u00a0<\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-d8c6178 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"d8c6178\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-facbc60\" data-id=\"facbc60\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-45eb174 elementor-widget elementor-widget-heading\" data-id=\"45eb174\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">An expedited licensing process<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a2c927 elementor-widget elementor-widget-text-editor\" data-id=\"1a2c927\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"translation-block\">The main goal in the field of licensing, as outlined in Amendment 101 to the Planning and Building Law, 5725-1965, is to streamline and improve the licensing processes without compromising the quality of construction. One of the ways to achieve this goal is to create differentiation between the licensing procedures, defining three pathways: a full licensing process, an expedited licensing process, and works and uses that will be exempt from permits. You can read more about it <a href=\"https:\/\/www.nevo.co.il\/law_html\/Law01\/044_001.htm#Seif458\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/p>\n<p>In accordance with Section 145B of the Pergolas Law of 2020, the Minister of Finance was granted the authority to determine types of buildings, works, and uses that may be subject to expedited licensing procedures, provided they meet the following criteria:<\/p>\n<div>\u2022 They do not create immediate danger or disruption<\/div>\n<div>\u2022 They do not substantially affect the appearance of the building, the environment, or its characteristics and features<\/div>\n<p>The regulations for an expedited licensing process shall not apply to an application for a permit:<\/p>\n<div>\u2022 That includes an exemption under Section 147 of the law or a deviation of use under Section 146 of the law<\/div>\n<div>\u2022 That requires approval or discussion by a planning institution that is not the licensing authority as a condition for granting the permit<\/div>\n<div>\u2022 For types of buildings or works that fall within the scope of a site, area, or building designated for preservation according to an approved plan or an approved preservation list under the Fourth Amendment to the law;\n\nWith these criteria in mind, the expedited licensing process regulations will not apply to permit applications that meet any of the above conditions.<\/div>\n<div>\u2022 Which, due to its age, is subject to the obligation of strengthening the building against earthquakes<\/div>\n<div>\u2022 That involves a new construction method<\/div>\n<div>\u2022 That includes an addition of one or more residential units<\/div>\n<p>In order to ensure that these buildings\/works are carried out in a professional and safe manner, both for the residents and those in their vicinity, the Minister of Finance has been authorized to determine specifications and conditions for these types of buildings and works.<\/p>\n<p><img decoding=\"async\" class=\"size-medium wp-image-10865 aligncenter\" src=\"https:\/\/smartpergola.co.il\/wp-content\/uploads\/2020\/07\/\u05db\u05e8\u05de\u05d9\u05d0\u05dc-300x225.jpeg\" alt=\"\u05d7\u05d5\u05e7 \u05d4\u05e4\u05e8\u05d2\u05d5\u05dc\u05d5\u05ea 2020\" width=\"300\" height=\"225\" srcset=\"https:\/\/smartpergola.co.il\/wp-content\/uploads\/2020\/07\/\u05db\u05e8\u05de\u05d9\u05d0\u05dc-300x225.jpeg 300w, https:\/\/smartpergola.co.il\/wp-content\/uploads\/2020\/07\/\u05db\u05e8\u05de\u05d9\u05d0\u05dc-1024x768.jpeg 1024w, https:\/\/smartpergola.co.il\/wp-content\/uploads\/2020\/07\/\u05db\u05e8\u05de\u05d9\u05d0\u05dc-768x576.jpeg 768w, https:\/\/smartpergola.co.il\/wp-content\/uploads\/2020\/07\/\u05db\u05e8\u05de\u05d9\u05d0\u05dc-1536x1152.jpeg 1536w, https:\/\/smartpergola.co.il\/wp-content\/uploads\/2020\/07\/\u05db\u05e8\u05de\u05d9\u05d0\u05dc.jpeg 1600w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<div class=\"translation-block\">The Planning and Building Regulations (Expedited Licensing Process), 5777-2017 (hereinafter referred to as the \"Expedited Licensing Process Regulations\"), specify general conditions and a list of works that can be discussed in an expedited licensing process if they meet the conditions established by law and regulations.\n\nYou can read the full text of the regulations <a href=\"https:\/\/www.nevo.co.il\/law_html\/Law01\/501_639.htm\" target=\"_self\">here<\/a>.<\/div>\n<p><strong>General Conditions - Pergolas Law of 2020:<\/strong><\/p>\n<div>The general conditions apply to all the works and uses specified in the regulations.&nbsp;<\/div>\n<div>\u2022 An application for a permit regarding types of buildings, works, and uses specified in Part B of the regulations will be discussed in an expedited licensing process<\/div>\n<div class=\"translation-block\">\u2022 The regulations for the expedited licensing process will be subject to the provisions of the Planning and Building Regulations (Application for Permit, Its Conditions, and Notices), 5730-1970, as amended in the regulations for the expedited licensing process.\n\nYou can access the full text of these regulations <a href=\"http:\/\/www.nevo.co.il\/Law_word\/law01\/044_046-tafrit.doc\" target=\"_self\">here<\/a>.<\/div>\n<div>\u2022 The provisions of Part Z, Part H, Chapter A, and Part T of the Building Licensing Regulations will not apply to the works specified in the regulations for the expedited licensing process unless it is determined that they require approval from a control institute.&nbsp;<\/div>\n<div>\u2022 All buildings, works, and uses in the expedited licensing process will be carried out by the owner of the rights to the land or the rights enabling the execution of the works. An owner of rights to the land is someone with registered rights in the Land Registration Office (long-term lease, ownership, rent, profit-sharing, preemption right, mortgage). An owner of rights to the land is someone with a contractual right regarding the rights registered in the Land Registration Office, but their right has not yet been registered for various reasons.
